    Welcome to InstantGrade.ai ("the Service"), an integrated digital infrastructure intended for highly automated text analysis and formative feedback. The platform is designed to utilize the capabilities of the Google Gemini API to generate machine-based assessments of text material, with a special focus on pedagogical use. We base our models on the Swedish National Agency for Education's grading criteria and training on student examples that we have explicit permission to use. We may also use uploaded texts to develop and improve the Service. The Service is owned and managed by InstantGrade.ai ("We", "Us", "Our"). By registering, accessing, or otherwise using the Service, you hereby confirm your full acceptance of these Terms of Use ("the Terms") as well as the supplementary terms and privacy policies applied by our technological and financial partners, Google (https://policies.google.com/privacy) and Stripe (https://stripe.com/legal). Failure to accept these Terms means that use of the Service is prohibited.

    1. Definitions

    • The Service: The collective set of functionalities, algorithmic processes, content, interfaces, and technical solutions provided by InstantGrade.ai.
    • We/Us/Our: InstantGrade.ai and its authorized partners, licensors, and subcontractors.
    • You/The User: The natural or legal person who enters into an agreement with or uses the Service.

    2. The Service's Functional and Pedagogical Framework

    The Service is designed to perform advanced text analysis with the support of the Google Gemini API, where the result is presented in the form of structured feedback. This feedback is of a formative and advisory nature and cannot replace the summative assessment for which a qualified educator is responsible. The Service is intended to optimize learning processes, free up educators' time, and enable more granular and individualized feedback.

    3. User Authentication and Account Security

    Access to certain parts of the Service requires the establishment of a verified user account via Firebase Authentication. The user bears full responsibility for managing their authentication credentials and for all activity initiated under their identity. In case of suspected intrusion or unauthorized activity, the user is obliged to notify us without delay.

    4. Data Processing and Legal Compliance (GDPR)

    We are committed to strictly complying with the EU's General Data Protection Regulation (GDPR) and to only processing personal data to the extent necessary for the functioning and continuous development of the Service. All entered texts are stored within the EU (currently in Firebase, Belgium) and forwarded to the Google Gemini API for processing. We may, in accordance with applicable law and these Terms, use uploaded texts for the purpose of developing and improving the Service. We use Google Analytics to analyze usage patterns and Stripe for payment transactions. Only authorized system administrators have access to data and only for purposes consistent with these Terms. The user has the right to access, rectify, delete, restrict processing of, and port their data, as well as to object to processing.

    5. Communication and Marketing

    By creating an account and accepting these terms, you consent to receive communication from us via email. This may include important information about the Service, updates, as well as newsletters and offers about our products. You can unsubscribe from marketing communications at any time via a link in each email.

    6. Interaction with Google Gemini API

    By using the Service, you agree that your texts will be processed by the Google Gemini API in accordance with Google's own terms and privacy policy. We disclaim responsibility for how Google handles data after transfer.

    7. Financial Terms, Subscription Model, and Use Restrictions

    The Service provides certain premium features for a fee. Payments are administered by Stripe, and we never store complete payment card details. Subscriptions are time-based (monthly) and are automatically renewed unless canceled before the current period ends. Any price adjustments will be communicated at least thirty (30) days in advance. Cancellation of a subscription takes effect at the end of the current period; no proportional refund is given for unused time. Creating multiple accounts to avoid payment, circumvent user limitations, or exploit the system is expressly prohibited. Violation may result in immediate suspension.

    8. Intellectual Property Rights

    All software, architecture, design, text, graphics, and other intellectual property components integrated into the Service are protected by applicable intellectual property law and belong to us or our licensors.

    9. User's Legal and Ethical Obligations

    The user shall ensure that the Service is used in accordance with applicable law, good practice, and these Terms. It is prohibited to distribute content that is illegal, offensive, or technically harmful, as well as to attempt to circumvent security mechanisms or interfere with the functionality of the Service.

    10. Disclaimer of Warranties

    The Service is provided "as is" and with the availability that applies at any given time. We do not guarantee that the Service will always be available, and interruptions or disruptions may occur. We make no guarantees regarding reliability, accuracy, or availability. All assessments should be considered indicative and not as final grades.

    11. Limitation of Liability

    We disclaim all liability for indirect or consequential damages, including but not limited to data loss, that may arise from the use of the Service.

    12. Indemnification

    The user is obliged to indemnify us from claims, costs, and damages arising from the user's breaches of these Terms.

    13. Amendment Procedure

    We reserve the right to revise these Terms at any time. Changes take effect upon publication, and continued use constitutes a binding acceptance of the changes.

    14. Applicable Law and Jurisdiction

    These Terms are governed by Swedish substantive law. Disputes will be finally settled by a competent Swedish court.
